Shark-Tober

1. Eligibility
1.1 The promotion is open to wholesale customers of EVOS Energy Pty Ltd (“EVOS”) with an active trading account in Australia.
1.2 This promotion is not open to the general public, resellers outside Australia, or employees of EVOS and their immediate families.

2. Promotion Period
2.1 The promotion runs from 1 October 2025 to 31 October 2025 inclusive (“Promotion Period”).
2.2 EVOS reserves the right to amend the Promotion Period at its sole discretion.

3. Qualifying Purchases
3.1 Rewards are available only on qualifying purchases of EVOS SB7 units during the Promotion Period.
3.2 A qualifying purchase must be made under one purchase order (PO). Multiple purchase orders cannot be combined to reach a reward tier.
3.3 Customers must have their account in good standing at the time of claiming the reward.

4. Rewards
4.1 Customers are entitled to claim one (1) reward only per qualifying purchase order. Rewards are not cumulative. For example, if a customer purchases five pallets, they will be entitled to the BYD Shark prize only and not the rewards for lower purchase quantities.
4.2 Rewards are strictly limited to the nominated party as designated by the purchasing organisation. Rewards are non-transferable, non-exchangeable, and cannot be redeemed for cash.
4.3 EVOS reserves the right to substitute any reward (including the BYD Shark) with another reward of equivalent or greater value at its sole discretion.

5. Collection & Delivery of Rewards
5.1 Rewards will be available for collection or delivery within three (3) months of the end of the Promotion Period.
5.2 Rewards (including the BYD Shark) will only be released once the relevant purchase invoice has been paid in full. Rewards cannot be collected or delivered while an account is under a credit term or has outstanding payments.
5.3 All prizes must be collected by, or delivered to, the nominated party of the purchasing organisation.

6. BYD Shark Prize
6.1 The BYD Shark prize has a notional value of AUD $55,000 (including GST). The 60V STEALTH Series Off-Road Mini Bike is valued at $2,999 (including GST).
6.2 The prizes does not include any associated or ongoing costs such as on-road costs, registration, stamp duty, insurance, fuel/charging, maintenance, or any other related expenses. These costs remain the responsibility of the winner.
6.3 EVOS is not liable for any delays, availability issues, or defects in the supply of the BYD Shark vehicle or any prize. Manufacturer’s warranty terms will apply.

7. Returns & Warranty
7.1 Purchases made under this promotion are final. Returns, restocking, or stock exchanges will not be accepted except as required under the normal product warranty.
7.2 Standard EVOS product warranty terms apply to all EVOS SB7 chargers purchased under this promotion.

8. General Conditions
8.1 EVOS reserves the right to vary, suspend, or terminate this promotion at any time without notice.
8.2 EVOS will not be liable for any loss, damage, or injury suffered or sustained in connection with the promotion or any prize, except for liability that cannot be excluded by law.
8.3 EVOS makes no representations or warranties as to the quality, suitability, or merchantability of any reward.
8.4 Participation in the promotion constitutes acceptance of these Terms & Conditions.
8.5 All decisions by EVOS regarding eligibility, qualifying purchases, and rewards are final and binding.

9. Governing Law
9.1 These Terms & Conditions are governed by the laws of Queensland, Australia.
9.2 Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
